These Terms of Service govern your use of vikingfactory.net and purchases from Viking Factory. In these Terms, "Viking Factory", "we", "us", and "our" refer to the store and services available through this website. By using the website or placing an order, you agree to these Terms. If you do not agree, do not use the website.

1. Eligibility and lawful use

You must be legally capable of entering a contract and must meet any minimum age required to buy or use our products in your location. Our products are storage, organization, preparation, and smoking-accessory products. We do not sell controlled substances.

You are responsible for checking and following the laws that apply to your purchase, possession, and use of a product. You may not use the website or our products for an unlawful purpose, to infringe another person's rights, or to transmit harmful code.

2. Accounts and information

If you create an account, you are responsible for keeping your login details secure and for activity under your account. You agree to provide current, complete, and accurate purchase and account information. Contact us promptly if you believe your account has been used without permission.

3. Product information

We aim to describe and display products accurately. Screen settings, natural materials, manufacturing tolerances, and photography may cause minor differences in colour, grain, finish, dimensions, or appearance. These variations do not affect any mandatory rights you have if goods do not conform to the contract.

Products, prices, promotions, and availability may change without notice before an order is accepted. We may limit quantities on a reasonable basis, including suspected resale, fraud, pricing error, or misuse of a promotion.

4. Orders and contract formation

Submitting an order is an offer to buy. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. A contract is formed when we confirm acceptance or dispatch the order, subject to applicable law.

We may reject or cancel an order before acceptance for reasons such as unavailable stock, an obvious pricing or description error, failed payment, suspected fraud, delivery restrictions, or legal requirements. If we cancel after taking payment, we will refund the amount charged.

5. Prices, currency, and payment

Prices and the transaction currency are shown before checkout. You authorize us and our payment providers to charge the selected payment method for the order total. You are responsible for any currency-conversion or bank fee charged independently by your payment provider.

6. Shipping, returns, and refunds

Delivery destinations, estimates, charges, and included import costs are governed by our Shipping Policy. Returns, exchanges, and refunds are governed by our Refund Policy. Those policies form part of these Terms.

The website and its content, including text, graphics, logos, photographs, videos, designs, and software, are owned by or licensed to Viking Factory and are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial shopping. You may not copy, reproduce, distribute, modify, scrape, sell, or exploit our content without prior written permission, except where law permits.

8. Reviews and other submissions

If you submit a review, photo, suggestion, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not infringe another person's rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content in connection with our business, subject to our Privacy Policy.

We may moderate or remove submissions that are unlawful, abusive, misleading, infringing, or unrelated. We do not require you to waive moral rights where such a waiver is prohibited by law.

Our store is hosted by Shopify and may use third-party payment, delivery, analytics, or support services. Third-party sites and services may have their own terms and privacy practices. We are not responsible for third-party content or services outside our reasonable control, but this does not limit responsibility that applicable law does not allow us to exclude.

10. Availability and disclaimers

We aim to keep the website available and accurate, but access may occasionally be interrupted for maintenance, security, or circumstances outside our control. To the fullest extent permitted by law, the website is provided without warranties beyond those expressly stated in these Terms or required by law.

11. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or breach of mandatory consumer rights.

Subject to that sentence, we are not liable for losses that were not reasonably foreseeable when the contract was formed, losses caused by your unlawful or improper use, or business losses arising from a consumer purchase. Any limitation applies only to the extent permitted by applicable law.

12. Indemnity

To the extent permitted by law, you are responsible for reasonable losses, liabilities, and costs arising from your unlawful use of the website, your infringement of another person's rights, or your material breach of these Terms. This section does not apply where the loss was caused by our act or omission and does not reduce mandatory consumer protections.

These Terms and any dispute or claim are governed by the laws of the Hong Kong Special Administrative Region. However, this choice does not deprive you of mandatory consumer protections available under the law of your country of residence.

The courts of Hong Kong have non-exclusive jurisdiction. This means you may also bring a claim in another court where mandatory consumer law permits, including the courts of your country of residence where applicable.

16. General terms

If any provision is held invalid or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. We may assign our rights or obligations as part of a business transfer where this does not reduce your rights; you may transfer your rights where law permits.
